ECS Blacklist Appeal Agreement

PLEASE READ THE FOLLOWING TERMS FOR APPEALING AN ENTRY IN OUR IP BLACKLIST. BY SUBMITTING AN APPEAL, YOU ACKNOWLEDGE AND AGREE TO BE BOUND BY THE FOLLOWING TERMS, AND YOU WARRANT THAT ALL INFORMATION PROVIDED IS TRUE AND ACCURATE.

THIS AGREEMENT IS EFFECTIVE AS OF 11/13/2019.

ACCEPTANCE OF TERMS

The following Blacklist Appeal Agreement (the “BAA”) is a legally binding agreement that shall govern the relationship between Engelhardt Creative Studios (“ECS), and any entity (“You”, “Applicant”, “The Applicant”) appealing an entry on our Suspicious Activity Blacklist (the “Blacklist”, “ECS IP Blacklist”, “IP Blacklist”).

BLACKLIST ENTRIES

IP addresses and their respective ranges get entered into the Blacklist when our systems detect suspicious activity, attacks or malicious activity, or repeated incidents of both. We update the publicly accessible Blacklist (located at https://ecreative.io/services/ip-blacklist) weekly irregardless of when the alleged activity occurred. This list is a statement of fact, ECS makes no statement of opinion of any services hosted on Blacklisted IP ranges or the organizations that run them.

APPEALS PROCESS

To start the appeals process, The Applicant must submit a ticket to our support staff through the form on the Blacklist page (https://ecreative.io/services/ip-blacklist). You will provide the information requested in the form, you will only provide information that is accurate and current. ECS will then process your request and provide a decision within 3 business days. By submitting an appeal You grant ECS permission to contact you via e-mail, telephone, and mail. After a decision is made on your appeal, You will receive a notification, any decision will be final and binding.

PRIVACY POLICY

Every Applicant’s data and various other personal information are strictly protected by the ECS Privacy Policy (see the full privacy policy at https://ecreative.io/legal/privacy). As an Applicant, you herein consent to the collection and use of the information provided, including the transfer of information within the United States and/or other countries for storage, processing or use by Engelhardt Creative Studios and/or our subsidiaries and affiliates.
